This Online Privacy Policy explains how emPower solutions, Inc. collects, shares, uses and protects information when you use the products offered by emPower Solutions, Inc.

Changes to the Privacy Policy

We reserve the right to change this privacy policy as we deem necessary or appropriate to reflect the changes in the law, our business practices, or the features of our product. Please check this page periodically for changes. Your continued use of our products following the posting of changes to our privacy policy will mean that you accept those changes.

What information we collect

We collect a variety of types of information. Examples include:

Personal Information

Personal information or personally identifiable information (PII) is information that, when used alone or with other relevant data, can identify an individual. You need an account before you can use emPower products. Personal Information is collected by emPower only when a system admin creates your account on behalf of your company, or else when you register for an account. In the scope of the products provided, the PII that is generally collected is first and last name and business email address.

Profile and account information

This includes your account password, first name, last name, and other information about your profile or account.

Email

When you send us an e-mail, we collect your email address and the information necessary to identify as the correct data subject.

Device Data

We collect data from the device and application you use to access our products, such as your IP address, device type, and browser type. Web servers, the main computers that serve up web pages, automatically collect this information. The automatically collected information also includes information about when and how you access and use our products. This information is used for system administration, auditing, troubleshooting, and support.

Log files

emPower products collect operational data consisting largely of non-personal and usage data generated by the emPower product in log files. These log files may include user IDs. Log files are saved locally within the customer environment. However, a customer may choose to send log files to emPower to assist with troubleshooting and support issues. Any content thus sent to emPower is processed to resolve the support issue only.

Children’s Data

If you are under 18, please do not send any personal data about yourself to us. emPower products are not designed or intended for minors. We do not knowingly allow such persons to use our product. Therefore, you hereby represent and warrant that your will not share or disclose such data to us. If you believe that we might have any information from or about a minor, please contact us using the contact information below.

Sensitive personal information

Sensitive personally identifying information is defined as information that if lost, compromised, or disclosed could result in substantial harm, embarrassment, inconvenience, or unfairness to an individual. Sensitive personal information includes (though is not limited to) Social Security Number (SSN), Student information, Personal Health Information (PHI) and Payment Card Information (PCI).

emPower products do not collect ‘Sensitive personal information.

You should never disclose sensitive personal information to emPower. Such a disclosure would be a violation of this privacy policy. In the event of such a disclosure, you, on behalf of your organization, acknowledge that all regulatory obligations (HIPAA or PCI) remain solely with you, on behalf of your organization.

Use of your personal data for direct marketing

emPower will not use information stored in our products for direct marketing.

Your Rights

When you are an end user, emPower acts as a controller, and you have the right to access, rectify, and erase your personal data. You also have the right to request a copy of your data. You may send us a request using the contact information below.

You also have the right to request that emPower correct any inaccuracies in your personal data. If you have an account with us, this can usually be done through the appropriate “my account” section(s) inside your emPower portal.

If you are an end user of our Customer (e.g. Customer’s employee or another person where the Customer is a Data Controller), emPower acts as the Processor. As Processor, emPower will not give access to personal data without instructions given by the data controller to do so. emPower does not have control over how your organization uses your business information. If you have questions or any other issues regarding your personal data that emPower processes, you should refer your requests to the controller.

Use of Cookies

emPower products use cookies. A cookie is a small file that is placed on your device to  ensures that everyone has the best possible experience. The usage of cookies is in no way linked to any personally identifiable information.

What type of cookies do we use?

Browser cookies – These cookies are used only when you are using our product. They disappear when you log out.

Support cookies – These cookies allow us to provide better products to our users.

How to turn off cookies

You can turn cookies off at any time, by going into your browser settings. Most browsers are set up to accept cookies. If you choose, you may refuse to accept cookies or select that your browser notifies you when you receive a cookie.

However, you should be aware that certain features of our product may not function properly without them.

Data Sharing

To provide our products, we may occasionally use third parties to perform specialized services on our behalf (e.g., without limitation, e-mail service providers, database management and other services). These third-party services may have access to your Personal Information. If they do, they are not permitted to use the data outside of the scope for which we contracted them, except to the extent required by law.

We may also share your information in the following circumstances:

  • To prevent, investigate, or take action regarding illegal activities and suspected fraud,
  • To confirm to legal requirements.

Messages for emPower

On occasion, emPower may need to contact you to provide user support. Primarily, these messages are delivered by email. Every account is required to keep a valid email on file to receive messages. emPower may also contact you by telephone to provide user support or for transaction-related purposes if you request that we call you. You may update your email address in your account settings.

How we protect data

We take precautions to protect your information. When you submit personal information via an emPower product, your information is protected both online and offline.

Wherever we collect personal information that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for “HTTPS” at the beginning of the address of the Web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees, agents and contractors who need the information to perform a specific job (for example, customer service) are granted access to personally identifiable information.

We may store your data on servers provided by third-party hosting vendors with whom we have contracted. We and our third-party service providers use industry-standard security measures to prevent unauthorized access, use or disclosure of your information.

Although we strive to employ reasonable protections for your information, we cannot guarantee or warrant the security of the information that you share with us. No Security system is 100% perfect and data breaches may still occur. We are not responsible for theft, destruction, loss or inadvertent disclosure of information.

California Data Privacy Rights

If you are a California resident, under California Civil Code Section 1798.83, you have certain additional rights, including the right to request information regarding the disclosure of your personal information to third parties for direct marketing purposes.

CAN-SPAM Act

The CAN-SPAM Act is a US law that sets the rules for commercial emails, establishes requirements for commercial messages, and gives recipients the right to have emails stopped from being sent to them.

We do not use information stored in our products for direct marketing.

Notice to European Union users

The operations of emPower Solutions are located primarily in the United States. If you provide information to us, the information will be transferred out of the European Union (EU) to the United States. By providing personal information to us, you are consenting to its storage and use as described herein.
